This is an extract from a letter dated 19 January 1999 from North Yorkshire Health Authority with names omitted.

II am writing to you further to my letter dated 12 January 1999 and following correspondence with your GP                 as a result of your non attendance at hospital on 11 January 1999.

In the course of the correspondence with Dr                 , the following health care regime has been proposed to deal with your health needs in the future:

  • If you feel that you have a medical problem then you should ring 999 for an ambulance and attend the casualty department where you can been seen and reviewed, if necessary, by an appropriate specialist.
  • You should also continue to be reviewed by the Sector Mental Health Team regarding your alleged agoraphobia and that they should continue to see you as they feel appropriate.
  • Your general practitioner (doctor) will continue to provide monthly prescriptions of any repeat medication and any new treatment instigated by the hospital.
  • An annual review of this situation would be provided which would be time limited and the doctor would be accompanied by a medical representative.
  • This proposal would therefore remove the need for you to contact the doctor’s practice and North Yorkshire Emergency Doctors Service.  Further calls made to the practice would not be transferred to the doctors and persistent calls to the practice may be treated as nuisance calls and dealt with accordingly.

I have considered this proposal very carefully and I am of the view that at the present time, it presents the only feasible way of dealing with your health care needs.

However, I am conscious that you telephoned the Health Authority yesterday indicating that your reason for not attending Hospital was because you did not feel that you would be independently examined by the doctors at the hospital and that you would prefer to be referred for the medical assessment to a hospital outside York.

I have considered your comments and I am prepared to consider your suggestion of facilitating a referral to a hospital outside York,  However, I do feel that before I can consider your request, you should provide me with a written guarantee that if a referral to an alternative hospital was achieved, you would attend the appointment.

I do feel that I must ask you to provide this guarantee as it would be an irresponsible use of scarce NHS resources to arrange for a medical assessment which was not subsequently attended. Once we have received a written guarantee that you will attend a hospital outside York for the medical assessment, I will do my best to facilitate the referral.

However, in the meantime, I do feel that it would be appropriate to instigate the proposals identified with Dr               , This would of course be reviewed following your attendance at hospital for the medical assessment.

I look forward to receiving the written guarantee from you that you will attend a hospital outside York for your medical assessment.

In the event that you choose not to agree to our request for a written guarantee, I do not believe that there is anything further that the Health Authority can do to assist you to determining your current health status. Consequently, the Health Authority will continue to support the health care regime mentioned earlier and you will be required to access medical care through the local hospital.
